Question 318: To ask the Minister for the Environment, Heritage and Local Government the position regarding the enactment of, and orders made or planned to be made, under Section 161 of the Local Government Act 2001 in respect of persons employed by local authorities and eligibility to be a member of a local authority; the way this will be implemented in respect of sitting councillors who wish to run for election in 2009; and if he will make a statement on the matter. Under the Local Government Act 2001, and subsequent (Section 161) Order, 2004, local authority employees whose maximum remuneration does not exceed the maximum remuneration for the grade of Clerical Officer are eligible to be members of a local authority.

Sitting councillors who wish to stand for election in 2009 will be subject to the above legislation. There are currently no plans for further orders.
