Section 39 of the Residential Tenancies Act 2004 sets out the circumstances in which family members of a tenant who has died may succeed to a tenancy. In the event that a landlord seeks, subject to the rights of the tenant under the Residential Tenancies Act 2004 and the terms of the availability agreement with the housing authority, to withdraw from the Rental Accommodation Scheme (RAS), the authority will move to secure alternative accommodation for the household concerned.
