Question 1391: To ask the Minister for the Environment, Heritage and Local Government if there are regulations in force to prevent estate agents advertising their non-acceptance of tenants claiming rent allowance for rental properties; if not, if he will examine the possibility of introducing such regulations; and if he will make a statement on the matter. My Department has no function regarding either the regulation of estate agents or the setting of advertising standards.
The Residential Tenancies Act 2004, under which the Private Residential Tenancies Board (PRTB) was established, sets out a framework for the governance of the landlord-tenant relationship, including the adjudication of disputes, and does not cover landlord behaviour prior to the commencement of a tenancy. I am not aware of any regulations governing the content of rental property advertisements placed by estate agents.
