Question 762: To ask the Minister for Justice, Equality and Law Reform his views on whether witness statements should be taken by gardaí without delay; and if he will take steps to eliminate all avoidable delays in the taking of witness statements. [29542/08]

I am informed by the Garda authorities that instructions to all members of An Garda Síochána state that witnesses should be formally interviewed as soon as possible after a crime.
Members of An Garda Síochána are also advised that the time chosen for the interview should be convenient to the witness and should provide adequate opportunity for a thorough interview and that interviews should not be conducted if the witness is not in a fit state to be interviewed.
