Question 897: To ask the Minister for the Environment, Heritage and Local Government further to Parliamentary Question Nos. 588 and 589 of 1 July 2008, in relation to the Castlewarden to Ballygoran water supply scheme, his views on whether the tender documents were supplied to his Department by Kildare County Council in good time; and if he will reconsider his decision not to allow this project to proceed using the old contracts. I refer to the reply to Questions Nos. 588 and 589 of 1 July 2008.

The flexibility in relation to the use of the old form of contract applies to certain tenders for water services contracts received by local authorities before 6 May 2008. The date of submission of tender documents to the Department is not a relevant factor in that context. As tenders have yet to be invited for Phase 2 of the Kildare Water Supply Scheme (Castlewarden to Ballygoran) the contract will have to be advanced in accordance with the new contract procedures.
