Question 424: To ask the Minister for Justice, Equality and Law Reform if his Department has received an application for residency in the State from a person (details supplied) in County Tipperary; if so, when a decision will be made on their application; and if he will make a statement on the matter. I would refer the Deputy to the reply to Parliamentary Question No. 879 put down for answer on the 2nd April 2008. The position in relation to long term residency is as follows: persons who have been legally resident in the State for over five years on the basis of work permit/work authorisation/work visa conditions may apply to the Immigration Division of my Department for a five year residency extension. In that context they may also apply to be exempt from employment permit requirements.

The Immigration Division of my Department received an application for long term residency in February 2006 from the person referred to by the Deputy. In June 2006 the person concerned was refused on the grounds that he had insufficient time spent working in the State. The Immigration Division of my Department has no record of having received any subsequent application for long term residency from the person concerned since June 2006.
