Question 118: To ask the Minister for Communications, Energy and Natural Resources his views on whether it is appropriate that An Post has a specific role in postal regulation under clause 8(3) of S.I. 616 of 2002; his further views on whether this role should instead be granted to the regulator; and if he will make a statement on the matter. The postal regulations provide that An Post may apply to the High Court to make an order prohibiting the provision by an individual of services legally reserved for An Post. The reserved area has been gradually reduced since 2000 and the transposition of the third postal directive into Irish law will see the complete removal of the reserved area on 31 December 2010. Consequently, postal regulation 8(3) will no longer be relevant.
