Question 433: To ask the Minister for the Environment, Heritage and Local Government if his attention has been drawn to the identity of each statutory instrument falling within his Department's remit which has statutory effect under the European Communities Act 1972 or other legislation specifically relating to same; if he will provide a list of such statutory instruments having statutory effect; and if he will make a statement on the matter. Since the European Communities Act 1972 was enacted over 35 years ago, it has not been practicable to draw to my attention each statutory instrument within my Department's remit which has statutory effect under that Act. Statutory instruments having statutory effect under this Act can be accessed in the Irish Statute Book on the internet at www.irishstatutebook.ie. While information on that web site is not complete for 2005, 2006 and 2007, my Department's annual reports for those years contain lists of all statutory instruments, including those implementing EU legislation, made by the Minister for the Environment, Heritage and Local Government, or by the relevant Ministers of State, in those years. The Department's annual reports for 2005 and 2006 are available on the website www.environ.ie and the 2007 report will be published on the site shortly.
