The application referred to by the Deputy was for a "Join Spouse" visa and it was received in the Visa Office, Dublin on 30 August 2007. It was refused by the Visa Officer on 21 September 2007 because of, inter alia, the applicant's immigration history — he was deported from the State in 2003. The applicant appealed against this decision.

The applicant sought to have the Deportation Order revoked and a determination on the Visa Appeal was postponed pending the outcome of that process. The applicant was informed in a letter of 12 March, 2008 that the application for revocation had been refused. As the effect of a deportation order is that the person must remain out of the State, the visa appeal was also refused.

I am informed by the Immigration Division of my Department that the wife of the person referred to by the Deputy was admitted to the State in November 2004 as a programme refugee. The person in question is the subject of a Family Reunification application made by his wife in April 2006. This application will be considered by my Department and a decision will issue in due course.
