Question 227: To ask the Minister for Transport if there is a provision in traffic legislation for the prosecution of traffic signal violations on the basis of camera evidence; if not, the reason for same; if he will address this legislative loophole; the traffic violations that can and can not be prosecuted on the basis of camera evidence; his views on the installation of cameras at traffic junctions to deter traffic violations at these critical locations; and if he will make a statement on the matter. The breach of traffic signal regulations is an offence under section 35 of the Road Traffic Act 1994. Section 35 offences are included in the list of offences set out in section 21 of the Road Traffic Act 2002 where evidence produced by equipment, including a camera, can be used in the prosecution of an offence. The prosecution of road traffic offences and the form of evidence that may be presented in any instance are matters for the Garda Síochána.
