Question 540: To ask the Minister for the Environment, Heritage and Local Government if he will inform immediately the Department of Justice, Equality and Law Reform and the Garda Commissioner of any decision he is taking or has taken regarding the Rath Lugh site and the adjacent esker or other historical site along the route of the proposed M3, protected structures under the National Monuments Act 1930; and if he will make a statement on the matter. Question 541: To ask the Minister for the Environment, Heritage and Local Government if he has informed the Department of Justice, Equality and Law Reform, a company (details supplied) and the Garda Commissioner of his decision that the Rath Lugh site and the adjacent esker are protected structures under the National Monuments Act 1930 and no further excavation of the site must occur. I propose to take Questions Nos. 540 and 541 together.

On 28 September 2007 I placed a temporary preservation order on the national monument at Rath Lugh, in the townland of Lismullin, Co. Meath under Section 4 of the National Monuments (Amendment) Act 1954. On 7 March 2008, I made that temporary preservation order, which was due to expire later this month, permanent under Section 8 of the National Monuments Act 1930 (as amended). Notification of the making of the temporary preservation order was issued to the Garda Síochána, Meath County Council, Coillte Teoranta and the National Roads Authority, among others, informing them of the implications of the order under the National Monuments Acts and requesting their co-operation in the preservation of the national monument at Rath Lugh; they will similarly be notified of the making of the permanent preservation order.

All archaeological works in relation to that part of the national monument at Lismullin, Co. Meath within the landtake for the M3 motorway have been completed in line with the statutory directions issued by the Minister for the Environment, Heritage and Local Government in this matter in June 2007. In order to ensure its protection, on 18 January 2008 I entered that part of the national monument at Lismullin, Co. Meath which lies outside the land-take for the M3 motorway onto the statutory Register of Historic Monuments under Section 5 of the National Monuments (Amendment) Act 1987. Notification of this registration was duly issued to the relevant landowner.
