Question 468: To ask the Minister for Justice, Equality and Law Reform if an application from a person (details supplied) in County Kilkenny for permission to live and work in the State on the basis of marriage to an Irish national has been received in his Department; if all documentation required for processing of this application has been submitted; when a decision will be made in relation to this application; and if he will make a statement on the matter. An application for residence in the State on the sole basis of marriage to an Irish national was received from the person in question in February 2008. The Immigration Operations Division of my Department issued an acknowledgement of this application and request for documentation on 26 February 2008.

Applications of this kind, in fairness to all other applicants, are dealt with in strict chronological order and currently take up to twelve months to process. It should be noted that marriage to an Irish national does not confer an automatic right of residence in the State.
