Question 186: To ask the Minister for Health and Children if she has received a report on the legal defence by the State of cases seeking to recover the private nursing home costs incurred by medical card holders; if hearings of these cases have commenced; if the substantive case has been heard; and if she will make a statement on the matter. I understand that the Deputy's question refers to legal cases concerning people in private long stay in-patient facilities. The Department of Health & Children and the HSE are involved in a number of cases relating to this area. These cases are being dealt with in the ordinary way in accordance with legal advice that the Department is receiving from its legal advisers. It would not be appropriate to make further comment at this time as these matters are currently before the courts.
