Question 843: To ask the Minister for Agriculture, Fisheries and Food if she will confirm that a person (details supplied) in County Wexford has been awarded payment and will continue to be awarded payment for the 0.27 hectares previous by under query under the single farm payment; if payment for this disputed land under the 2006 single farm payment will be awarded; and if she will make a statement on the matter. An application under the 2006 Single Payment Scheme was received from the person named on 21 April 2006. Following initial processing, one parcel claimed by the person named was identified as having also been claimed by another applicant. Having been written to regarding this issue, the person named contacted my Department to confirm that he did have the right to claim this parcel. To confirm this claim, the person named was requested to submit Land Registry Deeds or Lease/Rental agreements to support his right to claim this parcel. As no such evidence was received from the person named, the regulatory penalty was applied in accordance with the provisions governing the Single Payment Scheme. The person named has been advised of his right to appeal this decision.

Question 844: To ask the Minister for Agriculture, Fisheries and Food the reason a person (details supplied) in County Westmeath has not received their appropriate top up payment entitlements from the single payment scheme national reserve for 2006/2007; if she will take steps to have payments awarded; and if she will make a statement on the matter. The person named submitted an application for an allocation of entitlements from the 2006 Single Payment Scheme National Reserve under Categories A and B. Category A caters for farmers who inherited land or received land free of charge or for a nominal sum from a farmer who had retired or died by 16 May, 2005 and who had leased out his/her holding to a third party during the reference period 2000 to 2002. The person named was not eligible under this category as the land inherited by him was not leased out to a third party during the reference period. Category B caters for farmers who commenced farming after 31 December 2002 or who commenced farming in 2002 but who received no direct payments in respect of that scheme year. The person named was deemed eligible under this category and a formal letter outlining my Department's decision has issued to him. The allocation from the National Reserve was made after the 2007 Single Payment balance was paid in December. The relevant top-up payments due from the National Reserve for 2006 and 2007 will issue this week.
