Question 83: To ask the Minister for Justice, Equality and Law Reform the consideration given to date to implementing arrangements between this State, the United Kingdom and other European Union member states for the reciprocal enforcement of pension adjustment orders made in matrimonial proceedings; if his attention had been drawn to the fact that considerable difficulties can arise as a consequence in particular of trustees of English pension schemes being unwilling to comply with pension adjustment orders made by the courts here; and the action he will take to address this difficulty. My Department has no plans to negotiate bilateral reciprocal arrangements for the recognition and enforcement of pension adjustment orders with each of the Member States of the European Union. The EU Commission's current work programme on civil judicial co-operation aims to create an area which envisages rules on jurisdiction, recognition and conflicts of laws in the civil law field. The issue of pension adjustment orders may be addressed within this context.
