Question 413: To ask the Minister for Agriculture, Fisheries and Food if, in relation to a person (details supplied) in County Wexford the legal issues involved in this case have been considered in full by her Department in the two months which have elapsed since her reply to Parliamentary Question No. 109 of 27 September 2007; when a decision will be made in this case; and if she will make a statement on the matter. As previously indicated to the Deputy, the determination in question has given rise to some legal and other issues which are being considered in full by this Department.
The Department is continuing to receive legal advice in the matter, and a decision will be made as to the proper course of action in due course. Once this decision has been made the applicant will be notified as a matter of priority.
I would point out to the Deputy that since my Department is taking legal advice, the subject matter of the question is now in the realm of legal professional privilege.
