Question 307: To ask the Minister for Justice, Equality and Law Reform if his attention has been drawn to the considerable number of shops, petrol stations and book stores which display magazines with pornographic images on them, which are freely available to children without having a sealed cover bearing the name of the magazine on it before it is sold; his views on legislation to ensure that such outlets must have a sealed opaque cover on the magazine before the sale; and if he will make a statement on the matter. I can inform the Deputy that any person may make a complaint regarding a publication to the independent Censorship of Publications Board in accordance with the provisions of the Censorship of Publications legislation, and in particular the Censorship of Publications Regulations, 1980. The Board's only function is to decide whether or not to prohibit a publication. In the event that a publication is prohibited it is an offence to sell or distribute that publication. Neither my Department nor the Board has any power to apply restrictions with respect to the display in retail outlets of items which are not prohibited under the Act.
