Question 337: To ask the Minister for Social and Family Affairs the reason a person (details supplied) in County Mayo who had successfully appealed a decision by his Department was only left a claim for a short length of time; and the reason it has been refused again. [29526/07]

The person concerned was in receipt of jobseeker's benefit from 12 October 2005. Following a review of her entitlements, a Deciding Officer disallowed the jobseeker's benefit claim of the person concerned from 10 May 2007 on the grounds that she was not genuinely seeking full-time work. The person concerned appealed this decision. An Appeals Officer subsequently upheld the Deciding Officer's decision. An Appeals Officer's decision is final in the absence of new facts or fresh evidence.

Under Social Welfare legislation decisions in relation to claims must be made by Deciding Officers and Appeals Officers. These officers are statutorily appointed and I have no role in regard to making such decisions.
