Question 319: To ask the Minister for Enterprise, Trade and Employment further to Parliamentary Question No. 256 of 13 November 2007, if the requirements regarding a labour market test, eligible categories and minimum €30,000 salary are also waived in these cases. [29632/07]

The Employment Permits Section of my Department informs me that once the marriage of a non-EEA national to an EU national has been validated with the Department of Justice, Equality & Law Reform, the spouse of an EU national may enter the work force under the same conditions as any other EU national. However while the marriage is being validated the non EEA national requires an employment permit. The current policy in relation to new first time work permits will apply to all such applications. This includes the requirement for a minimum gross salary of €30,000 and a labour market needs test. All applications are considered on a case-by-case basis upon receipt into the Employment Permits Section.
