Question 302: To ask the Minister for Agriculture, Fisheries and Food, further to Parliamentary Question No. 392 of 23 October 2007, the length of time the legal advisers to her Department have been examining the issues referred to in the reply; when the examination will be concluded; and if she will make a statement on the matter. This concerns my Department's refusal to grant a foreshore lease to facilitate a Marina development as the developer does not have a means of access to the proposed site. The developer has raised certain legal issues concerning this refusal. Following consideration of all the issues associated with this case by officials of my Department it was decided that specific legal advice would be necessary. This was first sought on 28 May 2007. Consideration of the issues by my Department and its legal advisors has been ongoing since that date. I have asked my officials to expedite consideration of the matters raised.
