Question 112: To ask the Minister for Justice, Equality and Law Reform the action the Government will take as a result of the recent ruling of the High Court that the State is in breach of the European Convention on Human Rights because of its refusal to issue a person (details supplied) with a new birth certificate to reflect the gender change they had undergone; and if he will make a statement on the matter. I understand the effect of the judgment of the High Court in this case is that the system of registration of births, as it relates to those with gender dysphoria, is incompatible with the European Convention on Human Rights. The system of registration of births and the legislation governing that system do not come within the functional responsibility of my Department. This is a matter for the Department of Health and Children.
