Question 238: To ask the Minister for the Environment, Heritage and Local Government if he will take action under the building regulations to ensure that Dublin City Council carries out its duties in relation to a construction company (details supplied) which is refusing to carry out testing for pyrite infill at new houses in the north fringe, Dublin 13. Under the Building Control Act 1990, responsibility for compliance with the Building Regulations is a matter for the owner or builder of a building. Responsibility for enforcement of the Building Regulations is vested in the 37 local Building Control Authorities. Under the Act, authorities are empowered to carry out inspections of buildings and to take such samples of materials used in the carrying out of any construction work or take such other action in relation to such construction work as may be necessary to establish whether the requirements of Building Regulations are being complied with in relation to the building.

Under the Act, it would be a matter for the relevant Building Control Authority, in this case Dublin City Council, to initiate any necessary enforcement action in regard to the case referred to in the Question.
