Question 533: To ask the Minister for Justice, Equality and Law Reform the number of regulatory impact assessments produced by his Department since the adoption of the policy by Government; the number of appropriate decisions made by his Department which did not include such assessments; the reason for same; and if he will make a statement on the matter. My Department has completed 12 Regulatory Impact Assessments since the adoption of the Government's policy in this respect in June 2005, and a number of others are in preparation. The approach taken in assessing whether a Regulatory Impact Assessment (RIA) is necessary follows, on a case by case basis, the RIA Guidelines produced by the Department of The Taoiseach. Of particular note given my Department's remit is the fact that a RIA will not necessarily be required under the guidelines in the case of some emergency or criminal legislation, which the Deputy will appreciate has arisen on a number of occasions in my Department during the period in question.
