Question 63: To ask the Minister for Health and Children the number of cases that have been initiated against her Department in respect of the Government's refusal to meet necessary medical care provided to medical card holders in private facilities, at a time when public facilities were unable to meet their needs; the provision in the Health Acts she is relying upon to refuse these claims; if she has agreed to any out of Court settlements in respect of such cases; and if she will make a statement on the matter. I understand that the Deputy's question refers to legal cases concerning people in private long stay in-patient facilities. The Department of Health & Children and the HSE are involved in a number of cases relating to this area. These cases are being dealt with in the ordinary way in accordance with legal advice that the Department is receiving from its legal advisers. It would not be appropriate to make further comment at this time as these matters are currently before the courts.
