Question 135: To ask the Minister for Agriculture, Fisheries and Food if she has been informed of the sudden death of a person (details supplied) in County Galway; if she will have the matter investigated as to whether all proper procedures were followed in the case; if these procedures were in accordance with the Charter of Rights for farmers; if there will be sanctions if irregularities are confirmed; and if she will make a statement on the matter. On 6 March 2007 the person named was informed of a penalty which had been imposed following a compliance inspection. In accordance with proper procedures, he was told of his right of appeal to my Department's local AES local Office. No such appeal was received, and so my officials, being unaware that he had died in the meantime, wrote to the person named on 7 June to confirm the penalty and tell him of his right to appeal to the Agriculture Appeals Office.

I am satisfied that my Department followed the correct procedures in this case. However I have decided to waive the penalty in view of the fact that the person named sadly did not have an opportunity to avail fully of the appeals process. His outstanding REPS payments will be issued to his Representatives in due course.
