Question 193: To ask the Minister for Transport if his attention has been drawn to the concern regarding the apparently retrospective nature of sentences under the Road Traffic Act 2006 resulting from the wording of the order signed by him on 5 March 2007; if he will take action in this regard; and if he will make a statement on the matter. On 1 March 2007 I signed the Road Traffic Act 2006 (Commencement) Order 2007 (S.I. No. 86 of 2007). The Order brings into operation, with effect from 5 March 2007, sections 6, 7 and 18 of the Road Traffic Act 2006. Sections 6 and 18 have no retrospective application whereas section 7 applies to a disqualification order that "has been made, whether before or after the commencement of Section 7" and has a retrospective effect.
