Question 167: To ask the Tánaiste and Minister for Justice, Equality and Law Reform the steps a person (details supplied) in Dublin 9 must take in order to obtain a passport for their Irish born child; and if he will ensure that they are provided with the necessary documentation by his Department. The Irish Nationality and Citizenship Act 2004, which commenced on 1 January 2005, provides that certain non-nationals are required to be resident in Ireland for a period of three years prior to the birth of their child in order for that child to be entitled to Irish Citizenship.

As the person referred to in the Deputy's question is an E.U. national, there is no restriction on her period of residence and she should lodge an application for a passport on behalf of her child to the Passport Office. That office will then advise her of the documents she will be required to provide.
