Redundancy Payments

Question 191: To ask the Minister for Enterprise, Trade and Employment the way there could be no record of an application for redundancy in the case of a person (details supplied) in County Dublin, when it is understood that a record of an appeal against a decision exists in his Department; and if he will make a statement on the matter. As indicated in previous replies to PQ 9319/07 dated 8th March 2007, and PQ 3052/07 of 31st January 2007, there is no record of a redundancy claim or appeal having been received in the Redundancy Section of this Department in respect of the person concerned. However, if the Deputy has evidence to the contrary I will be happy to have the matter checked out on behalf of the individual concerned.

On making an employee redundant, it is up to the employer to pay the statutory payment in the first instance.

If an employee is dissatisfied with the decision of the employer, it is open to him to appeal the decision to the Employment Appeals Tribunal. However, such an appeal must be made within 12 months of the date of termination of employment. In exceptional cases, the Employment Appeals Tribunal may allow a further delay of 12 months.
