Question 31: To ask the Tánaiste and Minister for Justice, Equality and Law Reform when he expects to publish the Property Services Regulatory Authority Bill; if he will include powers to control charges imposed by estate agents having regard to recent reports that this sector was planning to increase its fees by up to 33%; and if he will make a statement on the matter. The Government Legislation Programme published on 30 January provides for publication of the Property Services Regulatory Authority Bill in 2007. Pending enactment of the legislation, I have established an Implementation Group to assist and advise on practical matters relating to the new body and to prepare for the new licensing system. A Chief Executive designate has also been appointed and is engaged in preparatory work for establishment of the Authority.

One of the key functions of the Authority will be to increase public awareness of property services and the cost to consumers of such services, as well as the risks and benefits associated with the provision of those services. The Authority will also require all providers of property services to issue an appropriate letter of engagement to clients. Regulations prescribing the form and content of the letter of engagement will provide that it shall include an outline of the basis on which the service provider's fee will be calculated.

I believe that these provisions will ensure greater transparency in the calculation of fees and charges for property services and lead to improved consumer awareness and consumer protection.
