Question 318: To ask the Tánaiste and Minister for Justice, Equality and Law Reform if he is satisfied that the questions raised in the course of examination of the application for refugee status in the case of a person (details supplied) in Dublin 22 were relevant and helpful in coming to an impartial decision in view of the fact that the services of an interpreter were required; if he has further satisfied himself that none of the questions were likely to confuse the applicant; and if he will make a statement on the matter. I propose to take Questions Nos. 307 and 318 together.

As the Deputy will be aware, applications for refugee status in the State are determined by an independent process comprising the Office of the Refugee Applications Commissioner (ORAC) and the Refugee Appeals Tribunal (RAT) which make recommendations to the Minister for Justice, Equality and Law Reform on whether such status should be granted.

I am informed that the case in question is under appeal before the Refugee Appeals Tribunal and accordingly, it would not be appropriate to comment further.
