Question 241: To ask the Minister for the Environment, Heritage and Local Government if he has received a railway order relating to the Kildare route project seeking his consent for the commencement of some provisions of the order affecting roads; if he has given his consent; and if he will make a statement on the matter. Under section 44(2)(b) of the Transport (Railway Infrastructure) Act 2001, the consent of the Minister for the Environment, Heritage and Local Government is required regarding the acquisition of rights in, under or over any public road specified in a Railway Order made under that Act. On 26 August 2006,the Department of Transport forwarded a draft Order to my Department in respect of CIE's application for a Railway Order for the Kildare Route Project and my Department is now finalising its consideration of this.
