Question 186: To ask the Minister for Community, Rural and Gaeltacht Affairs the settlement made on 31 October 2006 by his Department with an assistant secretary in his Department; and if he will make a statement on the matter. [37236/06]

On foot of legal advice a High Court case involving an Assistant Secretary in my Department was settled on the 31st October 2006.

The key elements of the settlement were that:

the case was struck out with no order;

no damages payable;

the Assistant Secretary in question would retire with immediate effect on full pension; and

the State would pay a contribution of €100,000 plus VAT towards the legal costs incurred by the Assistant Secretary.

The settlement has now been put into effect.
