Question 67: To ask the Minister for Enterprise, Trade and Employment in light of the fact that racial discrimination claims by migrant workers have more than doubled in the first half of 2006, his views on whether nine rights commissioners are sufficient to deal with the estimated 7,000 referrals for 2006. Claims of discrimination on the grounds of race are covered by Employment Equality and Equal Status legislation. Complaints under these pieces of legislation should be referred to the Director of the Equality Tribunal. The Rights Commissioner Service of the Labour Relations Commission has no function in the matter.

There are currently 9 Rights Commissioner posts in the Labour Relations Commission. In the context of the comprehensive package of measures on employment standards contained in the new partnership agreement, Towards 2016, an additional 5 Rights Commissioners posts will be provided, increasing, as necessary, in line with the Commissioners' caseload.
