Question 37: To ask the Minister for Transport the action he is taking to address the anomaly in the law whereby drivers of vehicles with non-transparent windows can flout the new law banning driving while holding a mobile phone; the reason for his inaction when both the Gardaí and the vehicle registration unit expressed a concern regarding same almost 12 months ago; and if he will make a statement on the matter. I have asked the Road Safety Authority to examine this matter as a priority. The Authority will be seeking the views of the Technical Advisory Forum for the National Car Test (NCT) on the matter. The establishment of an Advisory Forum body to consider and make recommendations to the RSA in relation to vehicle technical matters associated with the NCT regime was recommended in the report of the mid-term review of the national car testing service.

I understand from the Authority that it will shortly be seeking nominations from relevant organisations and stakeholders to serve on the forum and that it expects the forum to be constituted in the next few weeks.
