Question 1572: To ask the Minister for the Environment, Heritage and Local Government the extent to which section 25 of the Local Government Planning and Development Act 1976 and section 25 of the Planning and Development Act 2000 are employed by local authorities; the extent to which his Department recommends their use by local authorities; and if he will make a statement on the matter. Section 25 of the Local Government (Planning and Development) Act, 1976 and the equivalent provision of the Planning and Development Act, 2000 (section 45) relate to the acquisition of open spaces by planning authorities, in cases where, following a requirement by the local authority, the owner fails to maintain the land as open space. My Department does not have information on the use of these sections by local authorities and has not issued any advice to planning authorities regarding their use.

The information requested in relation to the 1999 Affordable Housing Scheme and Part V for the three months ending 31 March 2006 is set out in the table. In relation to the Affordable Housing Initiative over the same period, units were sold by Fingal County Council at an average price of €156,000.
