The minimum rates of pay and employment conditions of workers employed in the hotel and restaurant business are governed by either Employment Regulation Orders made pursuant to the provisions of the Industrial Relations Acts 1946 to 2004 or the National Minimum Wage Act, 2000. From the details supplied by the Deputy it would appear that the statutory minimum rates of pay for the person concerned are those set out in the Hotels Employment Regulation Order. This Order is enforced by the Labour Inspectorate of my Department. Labour Inspectors are empowered to seek compliance with payment of the statutory minimum rates of pay specified in the Order.

Following receipt of recent representations from the Deputy on behalf of the person referred to, the Labour Inspectorate has commenced an investigation in order to determine if the relevant employer is compliant with the minimum wage and other provisions of the Hotels Employment Regulation Order.
