Question 592: To ask the Minister for the Environment, Heritage and Local Government his views on the assumption made in Parliamentary Question No. 241 of 20 June 2006 that the provision of a bridge to Spike Island will be an exempted structure under Part 9 of the Planning and Development Regulations; and if he will make a statement on the matter. Part 9 of the Planning and Development Regulations, 2001 specifies, in accordance with section 181 of the Planning and Development Act 2000, that certain developments by or on behalf of State authorities which are in connection with or for the purposes of public safety or order, the administration of justice or national security or defence do not require planning permission. Instead, such development is subject to a public notification procedure set out in Part 9 of the Planning and Development Regulations 2001. Development on the foreshore is also subject to the requirements of the Foreshore Acts 1933 to 1998, which are administered by the Department of Communications, Marine and Natural Resources.
