Question 522: To ask the Minister for the Environment, Heritage and Local Government the reason a person who meets all eligibility criteria for the improvement works in lieu of rehousing scheme is deemed ineligible due to the fact that the local authority does not have first charge as the person has a mortgage on the property; if he will review this situation; and if he will make a statement on the matter. Under the Improvement Works in Lieu of local authority housing scheme, a local authority may improve or extend a privately owned house to eliminate defects or to provide additional accommodation where it is necessary to eliminate overcrowding or to accommodate a person not at present residing in the house. Persons benefiting under the scheme are required to pay a weekly or monthly charge calculated in relation to their means and the cost of the works carried out by the local authority. My Department is not aware of difficulties at local authority level in the operation of the scheme regarding the issue of the first charge on the property.
