Question 420: To ask the Minister for Justice, Equality and Law Reform if the completed file arising from a fresh Garda investigation into the circumstances surrounding the death of a person (details supplied) and which has recently been forwarded to the Garda Commissioner will be made available to the spouse of the deceased or to their solicitor. I am informed by the Garda authorities that a review of the investigation file into the collision referred to by the Deputy has been completed by a Garda Superintendent, and a copy of the resulting investigation file has been forwarded to the Law Officers for consideration.

I am further informed that Garda investigation files relating to road traffic accidents are not made available. However, an application may be made to the local District Officer (Superintendent) for the supply of an abstract of the Garda report, copies of statements of witnesses and sketches or maps of the scene of the accident.
