Question 288: To ask the Minister for the Environment, Heritage and Local Government if his attention has been drawn to the fact that local authorities are stating that tenants are deemed to have surrendered the tenancy of their council house on being committed to prison and councils are threatening families with legal proceedings to take possession under these circumstances. My Department has no role in relation to individual tenancy agreements, which are a matter for each housing authority. Tenancy agreements must comply with statutory provisions and Regulations, notably article 83 of the Housing Regulations 1980. Agreements provide the legal framework for the relationship between the housing authority and its tenants, and generally contain provisions in relation to behaviour by tenants. Failure to comply with these agreements may result in a housing authority seeking surrender of the dwelling. My Department is not aware of any case of the kind referred to in the Question.
