Question 446: To ask the Minister for Justice, Equality and Law Reform if a person (details supplied) has a right to appeal his decision either to the courts or a third party who could independently adjudicate on the case. [19620/06]

The member concerned was informed on 29 April, 2005 that my Department was proposing to recommend that his application be refused and he was also given an opportunity to forward further submissions and medical reports on his behalf. A reply was received from the member's legal representatives and his application was reviewed.

On 9 May 2006, the member was informed that his application had been refused. Under the provisions of Section 6(3) of the Garda Síochána (Compensation) Act 1941, a decision under the Act is final and conclusive.
