Question 120: To ask the Tánaiste and Minister for Health and Children the extent and level of support available to a person (details supplied) in County Kildare in the event of the release of their nephew by the courts into their guardianship and care; the extent to date of interaction between her Department and the Garda authorities on the issue in the past four months; and if she will make a statement on the matter. There has been no contact between the Department of Health and Children and the Garda authorities in this case, as such contact given the policy role of the Department would not be appropriate. Insofar as the case concerns child welfare issues, as the Deputy is aware it is a matter for the Health Service Executive which under the Health Act 2004 has statutory responsibility for the management and delivery of health and personal social services. Accordingly, my Department has requested the Parliamentary Affairs Division of the Executive to arrange to have this matter investigated and to have a reply issued directly to the Deputy.
