Question 258: To ask the Minister for Justice, Equality and Law Reform the protocol in place to allow members of the Gardaí to remove penalty point from a member of the public's driving licence, where it has been found that such points were wrongly imposed on that licence; and if he will make a statement on the matter. I am informed by the Garda authorities that the Department of Transport, on the written request of a Chief Superintendent, may remove penalty points from a driving licence in circumstances including where the individual named on the notification to the Minister for Transport was not the person who committed the offence or two notifications to the Minister for Transport were issued in respect of the same offence.
