Question 161: To ask the Tánaiste and Minister for Health and Children the immediate steps she is taking to implement the recommendations contained in the report of the investigation into complaints made by a person (details supplied) against the early intervention service and the Health Service Executive, north east region in December 2005. As the Deputy is aware the management and operation of health and personal social services is a matter for the Health Service Executive under the Health Act, 2004. There have been previous representations to my office on this matter and I have made inquiries with the Health Service Executive in that regard. The report of the independent investigation, to which the Deputy refers, made significant recommendations for services both locally in the north east and nationally. The recommendations for services locally are currently being implemented and nationally the HSE is reviewing policies and procedures in this area. This review will be informed by the need to provide for and protect the welfare of children while having regard to the rights of parents and guardians and relevant legislative requirements.

The Deputy's question relates to the management and delivery of health and personal social services, which are the responsibility of the Health Service Executive under the Health Act 2004. Accordingly, my Department has requested the parliamentary affairs division of the executive to arrange to have this matter investigated and to have a reply issued directly to the Deputy.
