Question 470: To ask the Minister for Transport if his attention has been drawn to instances whereby licensing authorities are refusing applications for provisional licences by EU nationals due to failure on the part of the applicant to provide a passport despite the provision of other documents of identification listed in official documentation as sufficient; the level of discretion afforded to licensing authorities with respect to the granting or refusal of provisional licences in such circumstances; the policy in place with regard to the required documentation for provisional licence applications by EU nationals and non-EU nationals; if such a policy is notified on the application documents; and if he will make a statement on the matter. Under the Road Traffic Act 1961 and the Road Traffic (Licensing of Drivers) Regulations 1999 to 2004, it is a matter for the appropriate licensing authority to determine the eligibility of a person for a provisional driving licence, and to issue licences.
The regulations provide for specific documentation to be submitted by an applicant for a provisional licence to a licensing authority in support of an application. A licensing authority may, in addition, at its absolute discretion, require an applicant to provide evidence of identity and for this purpose may require the applicant to produce any one of a wide range of listed documents.
