Question 870: To ask the Minister for the Environment, Heritage and Local Government if the provisions of the Planning Act 2000, including section 207, permitting a local authority to compulsorily acquire land for the purpose of creating or maintaining a right of way have ever been invoked; and if he will make a statement on the matter. A planning authority may create a public right of way by agreement — section 206 — or by order — section 207 — under the Planning and Development Act 2000. An appeal against the making of an order may be made to An Bord Pleanála, which may confirm the order with or without modifications or annul it. My Department has no role in this process nor does it have detailed information on the extent to which powers of the 2001 Act for creating public rights of way have been used.
