Question 406: To ask the Minister for Arts, Sport and Tourism if he is satisfied that he has and has always had power to hold and transfer shares in Campus and Stadium Ireland Development Limited; if he is further satisfied that the establishment of that company was valid and effectual; if previous dealings regarding the establishment of that company and the holding and transferring of its shares are at present vulnerable to legal challenge on grounds of lack of capacity on his part or on the part of other members of the Government; and if he will make a statement on the matter. Campus and Stadium Ireland Development Limited, CSID, was established under the Companies Acts, and all matters relating to the company are valid and effectual. I do not consider that any of the dealings relating to the company would be open to a successful legal challenge. The transitional provisions of the National Sports Campus Development Authority Bill 2006 ensure a smooth transfer between the company and the authority. One of those transitional provisions, section 38, confirms the power of the Taoiseach, the Minister for Finance and the Minister for Arts, Sport and Tourism to hold and transfer shares in CSID.
