Question 110: To ask the Minister for Communications, Marine and Natural Resources the number of occasions on which the electronic communications appeal panel have overturned decisions made by ComReg; the implications this has for the development of this industry; and if he will make a statement on the matter. In total, 11 appeals have been referred to appeal panels. One appeal by Hutchison 3G Ireland Limited was determined by an appeal panel finding in favour of the appellant. Six appeals concluded following the annulment of ComReg's decisions by an appeals panel. These six appeals related to findings of joint dominance by ComReg against Vodafone and O2. Four appeals were withdrawn prior to a determination by an appeal panel. These appeals were all brought by Eircom. Details of these appeals are available atwww.ecap.ie. Matters arising from the outcome of ECAP appeals are primarily a matter for ComReg, which is independent in the exercise of its functions under the provisions of the Communications Regulation Act 2002.

However, as part of my overall policy-making role for the telecommunications sector, I keep the operations of all the bodies under the aegis of my Department under review and where improvements are necessary to develop the overall environment in which the sector operates I will make them.
