Refugee Status

Question 244: To ask the Minister for Justice, Equality and Law Reform if he will review the decision not to grant refugee status in the case of a person (details supplied) in County Dublin in view of the existence of clear evidence to suggest a danger to their life and well-being if returned to their homeland; and if he will make a statement on the matter. The person concerned applied for asylum on 23 October 2003. The claim was investigated at first instance by the Refugee Applications Commissioner who concluded that the person concerned did not meet the criteria for recognition as a refugee. The commissioner's recommendation was communicated to the person concerned by letter dated 14 July 2005.

The person concerned appealed this recommendation to the Refugee Appeals Tribunal which, following consideration of the appeal, affirmed the earlier recommendation. The outcome of the appeal was made known to the person concerned by letter dated 7 February 2006.

In accordance with normal procedures, the file of the person concerned has been forwarded to the ministerial decisions unit in my Department for final processing. I understand that a representative of that unit will be writing to the person concerned in the coming days to inform them of my formal decision in their case and of the options now open to them vis-À-vis their position in the State.
