Question 273: To ask the Tánaiste and Minister for Health and Children, further to an Adjournment debate in 2005 seeking a review of the circumstances of the death of a person (details supplied), the reason the Mental Health Commission has referred the case back to the Health Services Executive; the further reason a review has not taken place; and if she will make a statement on the matter. I have been informed by the Mental Health Commission that the Inspector of Mental Health Services reviewed the documentation on the circumstances surrounding the death of the person concerned. The Mental Health Commission then requested the Health Service Executive to arrange a review of the case by suitably qualified medical personnel, which should include a consultant in emergency medicine. The details of this review are a matter for the Health Service Executive. Accordingly, my Department has requested the parliamentary affairs division of the executive to arrange to have this matter investigated and to have a reply issued directly to the Deputy.

The Mental Health Commission has been in contact with the husband of the deceased to inform him of the current situation.
